يحظر على صاحب العمل أثناء المفاوضة اتخاذ إجراءات أو إصدار قرارات تتعلق بالموضوعات المطروحة للتفاوض ، إلا عند قيام حالة الضرورة والاستعجال ، ويشترط أن يكون الإجراء أو القرار فى هذه الحالة مؤقتا .
