للطفل الحق فى نسبه إلى والديه الشرعيين والتمتع برعايتهما.
وله الحق فى إثبات نسبه الشرعى إليهما بكافة وسائل الإثبات بما فيها الوسائل العلمية المشروعة .
وعلى الوالدين أن يوفرا الرعاية والحماية الضرورية للطفل ، وعلى الدولة أن توفر رعاية بديلة لكل طفل حرم من رعاية أسرته ، ويحظر التبنى .
