إذا وقع الفعل المكون للجريمة تحت تأثير مرض عقلى أو نفسى أو ضعف
عقلى أفقد الطفل القدرة على الإدراك أو الاختيار أو كان وقت الجريمة مصابا بحالة مرضية
أضعفت على نحو جسيم إدراكه أو حرية اختياره ، حكم بإيداعه أحد المستشفيات
أو المؤسسات المتخصصة .
ويتخذ هذا التدبير وفقا للأوضاع المقررة فى القانون بالنسبة إلى من يصاب بإحدى
هذه الحالات أثناء التحقيق أو بعد صدور الحكم .
