للجهة المختصة بعد أخذ موافقة الهيئة الترخيص بالبناء فى الأماكن المتاخمة لمواقع الأثرية داخل المناطق المأهولة .
وعلى الجهة المختصة أن تضمن الترخيص الشروط التى ترى الهيئة أنها تكفل إقامة المبنى على وجه ملائم لا يطغى على الأثر أو يفسد مظهره ويضمن له حرما مناسبا مع مراعاة المحيط الأثرى والتاريخى والمواصفات التى تضمن حمايته . وعلى الهيئة أن تبدى رأيها فى طلب الترخيص خلال ستين يوما من تاريخ تقديمه إليها وإلا اعتبر فوات هذه المدة قرارا بالرفض .
