يتعين أن تراعى مواقع الآثار والأراضى الأثرية والمبانى والمواقع ذات الأهمية التاريخية عند تغيير تخطيط المدن والأحياء والقرى التى توجد بها ولا يجوز تنفيذ التخطيط المستحدث أو التوسع أو التعديل فى المناطق الأثرية والتاريخية وفى زمامها إلا بعد موافقة هيئة الآثار كتابة على ذلك مع مراعاة حقوق الارتفاق التى ترتبها الهيئة .
وعلى الهيئة أن تبدى رأيها خلال ثلاثة أشهر من تاريخ العرض عليها فإذا لم تبد رأيها خلال هذه المدة جاز عرض الأمر على الوزير المختص بشئون الثقافة ليصدر قرارا فى هذا الشأن .
