للوزير المختص بشئون الثقافة بناء على اقتراح مجلس إدارة الهيئة ومقابل تعويض عادل ترتيب حقوق ارتفاق على العقارات المجاورة للمواقع الأثرية والمبانى التاريخية لضمان المحافظة على خصائصها الفنية أو مظهرها العام ويحدد القرار الصادر بذلك العقارات أو أجزاء العقارات التى يترتب عليها حق أو أكثر من حقوق الارتفاق ونطاق هذا الحق والقيود التى ترد على حق المالك أو الحائز تبعا لذلك .
