إذا أسفر التحقيق عن وجود شبهات قوية تمس كرامة
الوظيفة أو النزاهة أو الشرف أو حسن السمعة جاز لمديرعام النيابة
الإدارية اقتراح فصل الموظف بغير الطريق التأديبى .
ويكون الفصل فى هذه الحالة بقرار من رئيس الجمهورية بناء على
عرض الوزير أو الرئيس المختص .
