Article 12 of the Administrative Prosecution and Disciplinary Trials Law

إذا رأت النيابة الإدارية حفظ الأوراق أو أن المخالفة
لاتستوجب توقيع جزاء أشد من الخصم من المرتب مدة لاتجاوز ١٥ يوما
تحيل أوراق التحقيق إلى الوزير أو من يندب من وكلاء الوزارة
أو الرئيس المختص .
وعلى الجهة الإدارية خلال خمسة عشر يوما من تاريخ إبلاغها بنتيجة
التحقيق أن تصدر قرارا بالحفظ أو بتوقيع الجزاء .
فإذا رأت الجهة الإدارية تقديم الموظف إلى المحاكمة أعادت الأوراق
إلى النيابة الإدارية لمباشرة الدعوى أمام المحكمة التأديبية المختصة .
ويجب على الجهة الإدارية أن تخطر النيابة الإدارية بنتيجة تصرفها
فى الأوراق خلال خمسة عشر يوما على الأكثر من تاريخ صدور قرار
الجهة الإدارية .
