لمن حفظ طلبه أن يطلب إلي أمين مكتب الشهر في خلال عشرة أيام من تاريخ إبلاغ قرار الحفظ إليه رفع الأمر إلي قاضي الأمور الوقتية بالمحكمة الابتدائية التي يقع مكتب الشهر بدائرتها.
ويصدر القاضي قراره علي النحو المبين بالمادة ٣٥ تبعا لتحقق أو تخلف الشروط التي يتطلب القانون توافرها لإجراء التأشير، ويكون قراره نهائيا.
