تعين المحكمة في حكم الإفلاس من جدول خبراء إدارة الإفلاس ممثلا قانونيا لإدارة التفليسة يسمى (أمين التفليسة) .
ويجوز في كل وقت لقاضى التفليسة من تلقاء نفسه أو بناء على طلب المفلس أو المراقب الأمر بإضافة أمين أو أكثر بشرط ألا يزيد عددهم على ثلاثة .
ويصدر بتنظيم مهنة أمناء التفليسات قرار من الوزير المختص .
