إذا طلب المدين شهر إفلاسه وقضت المحكمة برفض الطلب جاز لها أن تحكم عليه بغرامة لا تقل عن عشرة آلاف جنيه ولا تجاوز خمسين ألف جنيه إذا تبين لها أنه تعمد اصطناع الإفلاس .
وإذا طلب أحد الدائنين شهر الإفلاس وقضت المحكمة برفض الطلب يحكم على الدائن بالغرامة المنصوص عليها في الفقرة السابقة وينشر الحكم على نفقته في الصحف التي تعينها ، إذا تبين لها أنه تعمد الإساءة إلى سمعة المدين التجارية ، وذلك مع عدم الإخلال بحق المدين في طلب التعويض .
