لا يجوز لزوج طالب الصلح ولأقاربه حتى الدرجة الثانية الاشتراك فى مداولات الصلح أو التصويت على شروطه .
وإذا نزل أحد هؤلاء الدائنين المقبول دينهم نهائيا أو مؤقتا عن دينه إلى الغير بعد صدور الحكم بافتتاح إجراءات الصلح فلا يجوز للمتنازل إليه الاشتراك فى مداولات الصلح أو التصويت عليه .
