يقدم طلب الصلح الواقى من المدين إلى رئيس إدارة الإفلاس بالمحكمة المختصة على أن يتضمن أسباب اضطراب الأعمال ومقترحات الصلح متضمنة كيفية سداد المديونيات ، وترتيبها ، ومقترح تقسيم الدائنين إلى فئات وفقا لطبيعة الدين ، ونوعه ، والتمويل المقترح ، مع بيان مقداره ، وفائدته ، وجهة التمويل ، ومدته ، وكيفية تنفيذ هذه المقترحات .
