يتولى أمين التفليسة أو أمين اتحاد الدائنين بحسب الأحوال ، فى حضور قاضى
التفليسة ، إجراء المزايدة فى اليوم المحدد للبيع . وتبدأ المزايدة بالنداء على الثمن
الأساسى وتنتهى باعتماد قاضى التفليسة البيع على من تقدم بأكبر عرض ، ويعتبر العرض
الذى لم يزايد عليه خلال ثلاث دقائق منهيا للمزايدة .
