فى حالة وفاة المفلس يقوم ورثته مقامه فى إجراءات الإفلاس ، ولهم أن ينيبوا أحدهم ليمثلهم فى ذلك ، فإذا لم يتفقوا جاز لقاضى التفليسة بناء على طلب أمينها إنابة من يمثلهم ، وللقاضى فى كل وقت عزل من أنيب وتعيين غيره .
