لكل شخص أن يسترد من التفليسة الأشياء التى تثبت له ملكيتها أو حق استردادها وقت شهر الإفلاس .
ويكون لأمين التفليسة ، بعد أخذ رأى المراقب والحصول على إذن من قاضى التفليسة رد الشىء إلى مالكه أو صاحب الحق فى استرداده ، وإذا رفض طلب الاسترداد جاز لطالبه عرض النزاع على المحكمة .
