إذا استوفى الدائن من أحد الملتزمين بدين واحد جزءا من الدين ثم أفلس باقى الملتزمين أو أفلس أحدهم فلا يجوز للدائن أن يشترك فى التفليسات إلا بالباقى من دينه ويبقى محتفظا بحقه فى مطالبة الملتزم غير المفلس بهذا الباقى ، ويجوز لهذا الملتزم أن يشترك فى كل تفليسة بما وفاه عنها .
