إذا وجد جملة ملتزمين بدين واحد شهر إفلاس أحدهم فلا يترتب على هذا الإفلاس أثر بالنسبة إلى الملتزمين الآخرين ما لم ينص القانون على غير ذلك .
وإذا تم الصلح مع الملتزم الذى أفلس فلا تسرى شروطه على الملتزمين الآخرين .
