إذا دفعت قيمة ورقة تجارية بعد تاريخ التوقف عن الدفع وقبل الحكم بشهر الإفلاس فلا يجوز أن يسترد من الحامل ما دفع له ، وإنما يلزم الساحب أو من سحبت الورقة التجارية لحسابه برد القيمة المدفوعة إذا كان يعلم وقت إنشاء الورقة التجارية بتوقف المفلس عن الدفع ، ويقع الالتزام بالرد فى حالة السند لأمر على المظهر الأول إذا كان يعلم وقت حصوله على السند بتوقف المفلس عن الدفع .
