استثناء من حكم المادة ( ١٢١ ) من هذا القانون ، إذا حكم على المفلس بعد شهر إفلاسه بالتعويض عن ضرر أحدثه للغير قبل تقديم طلب شهر الإفلاس جاز للمحكوم له الدخول فى التفليسة بالتعويض المقضى به ما لم يثبت تواطؤه مع المفلس .
