يعين مساعد شرطة درجة ثانية بالترقية من درجة رقيب أول طبقا للشروط والأوضاع التى يحددها وزير الداخلية بقرار منه بعد أخذ رأى المجلس الأعلى للشرطة، ومع مراعاة أحكام المادة 90 من هذا القانون.
