إذا خلا مقعد عضو هيئة كبار العلماء لأى سبب من الأسباب انتخبت الهيئة عن طريق الاقتراع السرى المباشر عضوا آخر خلال ثلاثة أشهر من تاريخ إعلان خلو المقعد، من بين المستوفين شروط العضوية بشرط أن يرشح المتقدم اثنان من أعضاء الهيئة، ولا تكون جلسة الانتخاب صحيحة إلا بحضور ثلثى عدد الأعضاء، ويصبح المرشح عضوا إذا حصل على أعلى الأصوات للأعضاء الحاضرين ويصدر بتعيينه قرار من رئيس الجمهورية بناء على عرض شيخ الأزهر.
