يجوز لوزير الإصلاح الزراعى وإصلاح الأراضى عند الضرورة القصوى أن يقرر تجميع الأراضى الداخلة فى ملكية الدولة الخاصة قبل التصرف فيها وفقا لأحكام هذا القانون مع تعويض الغير من أصحاب الأراضى التى تخالطها أو تتداخل فيها على وجه يقلل من إنتاجها أو من تمام الانتفاع بها إما عينا أو نقدا حسب اختيار صاحب الشأن . فإذا لم يبد صاحب الشأن خيارا كان التعويض عينا . وتحدد اللائحة التنفيذية إجراءات التجنيب وقواعد التعويض العينى والنقدى وشروطه .
