لوزير الحربية اتخاذ إجراءات نزع ملكية الأراضى الصحراوية أو الاستيلاء عليها استيلاء مؤقتا إذا اقتضت ذلك دواعى المحافظة على سلامة الدولة وأمنها القومى الخارجى أو الداخلى وذلك دون اتباع الإجراءات المنصوص عليها فى القانون رقم ٥٧٧ لسنة ١٩٥٤ المشار إليه عدا ما يتعلق منها بتقدير التعويض .
وتحدد اللائحة التنفيذية الإجراءات التى تتبع فى نزع ملكية العقارات الصحراوية والاستيلاء المؤقت عليها فى الأحوال المشار إليها .
