يكون المسئول عن الإدارة الفعلية للشخص الاعتبارى مسئولا بالتضامن عن الوفاء بما يحكم به من عقوبات مالية وتعويضات طبقا لأحكام هذا القانون إذا كانت الجريمة قد ارتكبت من أحد العاملين به باسمه ولصالحه ، وثبت علمه بالجريمة ، وكان إخلاله بالواجبات التى تفرضها عليه تلك الإدارة قد أسهم في وقوع الجريمة .
