يعاقب بالحبس لمدة لا تتجاوز ثلاثة شهور وبغرامة لا تتجاوز خمسة وعشرين جنيها أو بإحدى هاتين العقوبتين كل من حاز بغير سبب مشروع مواد غذائية من المشار اليها فى المادة السابقة – وتكون العقوبة الحبس لمدة لا تتجاوز ستة شهور والغرامة التى لا تتجاوز خمسين جنيها إذا كانت المواد الغذائية التى وجدت فى حيازته ضارة بصحة الانسان.
