تنظر المحكمة الاستئنافية الدعوى بحالتها التى كانت عليها قبل صدور
الحكم المستأنف بالنسبة لما رفع عنه الاستئناف فقط .
ومع ذلك يجوز مع بقاء الطلبات الأصلية على حالها تغيير أسبابها أو الإضافة
إليها ، كما يجوز إبداء طلبات جديدة بشرط أن تكون مكملة للطلبات الأصلية أو مترتبه
عليها أو متصلة بها اتصالا لا يقبل التجزئة .
وفى الحالتين تلتزم المحكمة الاستئنافية بمنح الخصم أجلا مناسبا للرد على الأسباب
أو الطلبات الجديدة .
