Article 39 of the Personal Status Litigation Procedures Law

على النيابة العامة أن تقدم للمحكمة مذكرة مسببة بمن ترشحه للنيابة
عن عديم الأهلية أو ناقصها أو عن الغائب أو من ترشحه مساعدا قضائيا ، وذلك خلال
ثمانية أيام على الأكثر من تاريخ إبلاغها بالسبب الموجب لتعيينه .
وتعين المحكمة النائب أو المساعد القضائى بعد أخذ رأى ذوى الشأن .
