يجوز للقاضى بدلا من توقيع العقوبة المنصوص عليها فى الفقرة الأولى من المادة السابقة أن يصدر حكما غير قابل للطعن بانذار المشتبه فيه بأن يسلك سلوكا مستقيما .
فإذا وقع من المشتبه فيه أى عمل من شأنه تأييد حالة الاشتباه فيه فى خلال الثلاث السنوات التالية حكم وجب توقيع العقوبة المنصوص عليها فى الفقرة الأولى من المادة السابقة .
