يعد متشردا طبقا لأحكام هذا المرسوم بقانون من لم تكن له وسيلة مشروعة للتعيش ولا يعد كذلك من كان صاحب حرفة أو صناعة حين لا يجد عملا .
ولا يعتبر من الوسائل المشروعة للتعيش تعاطى أعمال وألعاب القمار والعجوزة والعرافة وما يماثلها .
