يجوز إعفاء الخصم المعسر من دفع الأمانة إذا تبين من قيمة الدعوى وظروفها ما يبرر ذلك ويندب فى هذه الحالة مكتب الخبراء أو قسم الطب الشرعى .
ويرجع بهذه الأمانة وما يتقدر من الاتعاب ومصروفات الخبير على الخصم المحكوم عليه بالمصروفات أو على الخصم المعفى إذا زالت حالة إعساره .
