تعفى من الرسوم القضائية كلها أو بعضها من يثبت عجزه عن دفعها :
و يشترط في حالة الاعفاء السابق على رفع الدعوى احتمال كسبها .
و يشمل الاعفاء رسوم الصور والشهادات والملخصات وغير ذلك من رسوم الأوراق القضائية والادارية ورسوم التنفيذ وأجر نشر الاعلانات القضائية والمصاريف الأخرى التي يتحملها الخصوم .
