لا يكلف بدفع الرسوم مقدما المدعى المأذون بالخصومة من تلقاء المحكمة نفسها ولم تكن خصومته لمنفعة تعود عليه ويحصل الرسم من المدعى عليه اذا فصل في الدعوى بالقبول كما يحصل الرسم من المدعى عليهما في دعوى التفريق حسبة بين الزوجين اذا فصل فيها بالقبول ومن المدعى اذا فصل فيها بالرفض .
