إذا لم ير المجلس الطبى العسكرى أن العاهة أو المرض قد بلغ من الشدة درجة تجعل المصاب أو المريض غير لائق للخدمة صحيا جاز للمريض أو المصاب أن يقدم تقريرا من طبيبين متضمنا وأيا مخالفا لرأى المجلس ويطلب تشكيل لجنة تؤلف من طبيب تعينه اللجنة الطبية العسكرية المختصة ومن طبيب آخر يختاره الطالب ومن طبيب ثالث تندبه نقابة الأطباء البشريين وتقدم هذه اللجنة تقريرا يتضمن ما إذا كانت العاهة أو المرض قد بلغ من الشدة درجة تجعل المصاب أو المريض غير لائق للخدمة .
