Article 38 of the Entry and Residence of Foreigners Law

كل من امتنع عن تنفيذ القرار الصادر بإبعاده أو خالف حكم المادة 30 يعاقب بالحبس مع الشغل مدة لا تقل عن ثلاثة أشهر ولا تزيد على سنتين وبغرامة لا تقل عن خمسين جنيها مصريا ولا تزيد على مائتى جنيه أو لا تقل عن أربعمائة وخمسين ليرة ولا تزيد على ألف وثمانمائة ليرة سورية. أو بإحدى هاتين العقوبتين وذلك مع عدم الإخلال بتنفيذ قرار الإبعاد. وفى حالة العود تكون العقوبة الحبس مدة لا تقل عن ستة أشهر.
