يجوز لمن صدر قرار من هيئة التأديب ضده كما يجوز للنقيب بناء على طلب لجنة التحقيق أن يستأنف القرار أمام هيئة الدرجة الثانية . و يكون ميعاد الاستئناف ثلاثين يوما من تاريخ إعلان القرار إلى المحكوم عليه إذا كان حضوريا أو من تاريخ انتهاء المعارضة إذا كان غيابيا . و يجوز لمن صدر قرار من هيئة الدرجة الثانية بتوقيع عقوبة تأديبية ضده أن يطعن فيه أمام محكمة القضاء الإداري بمجلس الدولة خلال ثلاثين يوما من تاريخ إعلانه بالقرار .
