يجوز لكل من العضو المقدم للمحاكمة ولجنة التحقيق وهيئة التأديب أن تكلف بالحضور على يد محضر الشهود الذين يرى سماع شهادتهم و من تخلف من هؤلاء الشهود بغير عذر مقبول أو حضر وامتنع عن أداء الشهادة أو شهد زورا أمام هيئة التأديب يحال إلى النيابة العامة وتجرى في شأنه أحكام قانوني العقوبات والإجراءات الجنائية .
