يجوز للمحكمة المختصة بناء على طلب كل ذى شأن أن تقضى بشطب تسجيل العلامة بحكم قضائى واجب النفاذ ، إذا ثبت لديها أنها لم تستعمل بصفة جدية - دون مبرر تقدره - لمدة خمس سنوات متتالية .
