الطلب المقدم من المخترع للحصول على براءة اختراع فى خلال سنة من تاريخ تركه المنشأة الخاصة أو العامة ، يعتبر كأنه قدم فى خلال تنفيذ العقد أو قيام رابطة العمل أو الاستخدام ، ويكون لكل من المخترع وصاحب العمل جميع الحقوق المنصوص عليها فى المادة السابقة تبعا للأحوال .
وتزداد المدة إلى ثلاث سنوات إذا أنشأ العامل أو التحق بمنشأة منافسة ، وكان الاختراع نتيجة مباشرة لنشاطه وخبرته السابقة بالمنشأة التى كان يعمل بها .
