يجوز نقل ملكية البراءة كلها أو بعضها بعوض أو بغير عوض ، كما يجوز رهنها أو تقرير حق الانتفاع عليها .
ومع عدم الإخلال بالأحكام الخاصة ببيع المحال التجارية ورهنها لا تنتقل ملكية البراءة ولا يكون رهنها أو تقرير حق انتفاع عليها حجة على الغير إلا من تاريخ التأشير بذلك فى سجل البراءات .
ويكون النشر عن انتقال ملكية البراءة أو رهنها أو تقرير حق الانتفاع عليها وفقا للأوضاع والإجراءات التى تحددها اللائحة التنفيذية .
