للمصلحة ولكل ذى شأن أن يرفع الدعوى إلى محكمة القضاء الإدارى بطلب شطب تسجيل التصميم أو النموذج الصناعى الذى تم بدون وجه حق ، وتقوم المصلحة بشطب التسجيل متى قدم لها حكم واجب النفاذ بذلك .
