يجوز لكل ذى مصلحة رفع الدعوى أمام المحكمة الابتدائية المختصة بالطرق المعتادة بطلب منع استخدام أى مؤشر جغرافى لم تتضمنه علامة تجارية مسجلة إذا كان من شأن هذا الاستخدام تضليل الجمهور بشأن المنشأ الحقيقى للسلعة .
وتكون المحكمة الابتدائية المختصة هى المحكمة التى يقع فى دائرتها مكان استخدام المؤشر الجغرافى .
