تنشأ هيئة عامة لمحو الأمية وتعليم الكبار، ذات شخصية اعتبارية، تتبع وزير التعليم.
وتتولى الهيئة وضع خطط وبرامج محو الأمية وتعليم الكبار ومتابعة تنفيذها والتنسيق بين الجهات المختلفة التى تقتسم مسئولية تنفيذ هذه الخطط والبرامج فى الدولة.
ويكون للهيئة مجلس ادارة برئاسة رئيس مجلس الوزراء أو من ينيبه، ويصدر بتشكيله وسائر تنظيمات الهيئة قرار من رئيس الجمهورية.
ويكون للهيئة جهاز تنفيذى يصدر بتعيين رئيسه وتحديد معاملته المالية قرار من رئيس الجمهورية بناء على عرض وزير التعليم لمدة ثلاث سنوات قابلة للتجديد.
