Article 354 of the Maritime Trade Law

(١) يسأل المؤمن عن الضرر المادي الذي يلحق
الأشياء المؤمن عليها بخطأ المؤمن له أو بخطأ تابعيه البريين لم يثبت
المؤمن أن الضرر ناشئ عن خطأ عمدى أو عن خطأ جسيم صادر
من المؤمن له .
(٢) ومع عدم الإخلال بحكم (الفقرة ٢) من المادة ٣٧٧ من
هذا القانون يسأل المؤمن عن الضرر المادي الذي يلحق الأشياء
المؤمن عليها بخطأ الربان أو البحارة .
