ترفع الدعاوى الناشئة عن عقد نقل الأشخاص
بالبحر إلى المحكمة المختصة وفقا للأحكام المنصوص عليها في قانون
المرافعات المدنية والتجارية، ويجوز أيضا حسب اختيار المدعى أن
ترفع الدعاوى المذكورة إلى المحكمة التي يقع في دائرتها ميناء
القيام أو ميناء الوصول أو الميناء الذي حجز فيه على السفينة، ويتم
باطلا كل اتفاق سابق على قيام النزاع يقضي بسلب المدعى الحق
في هذا الاختيار أو تقييده.
