تنقضي دعوى ضمان العيوب الخفية بمضي سنة من وقت العلم بالعيب ، كما تنقضي تلك الدعوى بمضي سنتين من وقت تسلم السفينة ما لم يثبت أن متعهد البناء قد تعمد إخفاء العيب غشا منه .
