يوقف للمفقود من تركة مورثه نصيبه فيها فإن ظهر حيا أخذه , وإن حكم بموته رد نصيبه إلى من يستحقه من الورثة وقت موت مورثه فإن ظهر حيا بعد الحكم بموته أخذ ما بقي من نصيبه بأيدي الورثة.
