إذا لم تستغرق الفروض التركة ولم توجد عصبة من النسب رد الباقي على غير الزوجين أصحاب الفروض بنسبة فروضهم.
ويرد باقي التركة إلى أحد الزوجين إذا لم يوجد عصبة من النسب أو أحد أصحاب الفروض النسبية أو أحد ذوي الأرحام.
