إذا اتحدت العصبة بالنفس في الجهة كان المستحق للإرث أقربهم درجة إلى الميت.
فإذا اتحدوا في الجهة والدرجة كان التقديم بالقوة فمن كان ذا قرابتين للميت قدم على من كان ذا قرابة واحدة فإذا اتحدوا في الجهة والدرجة والقوة كان الإرث بينهم على السواء.
