على النيابة العامة أن تخطر مجلس النقابة أو مجلس النقابة الفرعية بأى شكوى ضد أى صحفى تتصل بعمله الصحفى قبل الشروع فى التحقيق معه بوقت مناسب .
وإذا اتهم الصحفى بجناية أو جنحة خاصة بعمل الصحفى فللنقيب أو لرئيس النقابة الفرعية أن يحضر التحقيق بنفسه أو بمن ينيبه عنه .
